WAIVER AND RELEASE OF LIABILITY

Private Sound Bath at Mulberry House

I voluntarily choose to participate in a private sound bath and related activities (the “Event”) hosted at 5004 Hemlock Street, Sacramento, California, a private residential property (“Property”), and facilitated and/or hosted by Kelsey Eaton and Chali Temple (collectively, the “Hosts”).

By electronically accepting this Waiver and Release of Liability, I acknowledge that my electronic acceptance is intended to serve as my signature and agreement to the terms below.

Assumption of Risk:
I understand that participation in the Event and my presence on the Property involve inherent and other risks. These may include, but are not limited to, slips, trips, falls, uneven or wet surfaces, exposure to outdoor conditions, physical discomfort from sitting or lying for an extended period, and physical or emotional responses to sound, vibration, meditation, relaxation practices, or other activities associated with the sound bath.

I knowingly and voluntarily assume the risks associated with participating in the Event and being present on the Property, including the risk of personal injury, illness, property damage, or other loss.

Sound Bath Participation and Medical Considerations:
I understand that a sound bath is a wellness and relaxation experience and is not medical care, mental health treatment, or a substitute for professional medical advice, diagnosis, or treatment.

I understand that sound and vibration may not be appropriate for everyone. I am responsible for determining whether participation is appropriate for me and for consulting a qualified healthcare professional beforehand if I have a medical condition, sensitivity, implanted medical device, pregnancy, hearing condition, seizure disorder, or other concern that could affect my ability to safely participate.

I agree to stop participating or notify a Host if I experience discomfort or believe I cannot safely continue.

Release and Waiver of Liability:
To the fullest extent permitted by California law, I release and discharge Kelsey Eaton and Chali Temple, as well as the owners and occupants of the Property and any individuals assisting with the Event, from claims arising from my participation in the Event or presence on the Property, including claims arising from ordinary negligence, except to the extent that liability cannot legally be waived under California law.

I understand that by agreeing to this waiver, I am giving up certain legal rights that I might otherwise have.

Personal Property:
I understand that I am responsible for my own personal belongings while attending the Event. The Hosts are not responsible for lost, stolen, or damaged personal property except as otherwise required by law.

Emergency Medical Care:
If I experience a medical emergency during the Event, I authorize the Hosts to contact emergency medical services on my behalf. I understand that I am responsible for any costs associated with medical treatment or emergency transportation provided to me.

Indemnification:
To the extent permitted by California law, I agree to indemnify and hold harmless the Hosts and Property owners from third-party claims resulting from my own negligent or wrongful conduct while participating in the Event or while on the Property.

Photography and Video — Optional:
Photographs or videos may occasionally be taken during events at Mulberry House. My participation in the Event does not automatically constitute consent to the commercial or promotional use of my image.

Property Rules and Participant Conduct:
I agree to follow reasonable instructions provided by the Hosts regarding the Event and use of the Property. I understand that I may be asked to discontinue participation or leave the Property if my conduct creates a safety concern or substantially interferes with the experience of other participants.

Governing Law and Severability:
This Waiver and Release of Liability shall be governed by the laws of the State of California. If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

Acknowledgment and Electronic Acceptance:
I have carefully read and understand this Waiver and Release of Liability. I understand that participation in the Event is voluntary and that by accepting this agreement, I am assuming certain risks and giving up certain legal rights.
